A minor from Hyderabad, who was forced to marry a 35-year-old man last year, was served a legal notice for not leading a “marital life” with him and discharging “the duties of a housewife.”

The girl — presently pursuing polytechnic diploma course at a private college — received the notice from lawyer D Narender Rao, representing her husband Palsam Srikanth Goud a few days ago. Having no resources to fight the legal battle, she wrote to State Child Rights Association on Wednesday seeking help.

“She passed Class 10 in March last year and going by her school-leaving certificate, she was born on March 3, 2000. It shows she is still a minor. So, the marriage itself is illegal and demanding conjugal rights from her is all the more illegal. We are planning to move the high court against Srikanth and also the lawyer, who issued notice without even bothering to know her age,” association leader P Achyuta Rao told HT.

OK, so it’s an illegal child marriage and so on. But the fascination bit:

However, in the notice dated December 24, 2016, the lawyer accused the girl of behaving in a highly objectionable manner with Srikanth and his family members. “You have developed the habit of disliking your husband and not giving due respect to him. You never bothered to live marital life with him and failed to perform duties of a house wife,” he said.

    By the sounds of it, no. But clearly some people think that they should.

    I would argue that it is reasonable to call a refusal to have sex a form of abandonment. Women providing sex is like men providing material support – a necessary and central part of married life. But if that was the law, there would hardly be any married couples left in the UK.

  2. In my last divorce the grounds for unreasonable behaviour was that my then wife wasn’t providing sex. Circa 2009

    I can think of a few couples who for medical reasons have stopped having sex. Are they still married?

  5. You could apply for a court order for “restitution of conjugal rights” in England until 1970.

    From 1813 to 1884, the spouse could be imprisoned for six months for failing to comply (although I don’t know whether that actually happened); after that it was just grounds for divorce.

    It wasn’t actually a court order for nookie, just to live together, but since there was deemed consent to sex for a married couple living together, I suppose it would depend on who was stronger.

  7. In fact, it would be interesting to know in general how many bits of anti-PC English Law still exist in other parts of the world. For example, in the Republic of Ireland and Norn Ireland.

  8. Methinks the gal is entitled to the same intervention as that provided by the British officer happening on the preparation for a widow to be burnt on her deceased husband’s funeral pyre:

    “I understand that you folks have a custom of burning the wife of man who has died. I understand and respect your custom but must explain we British also have a long-established custom–and that is to hang each and every man involved in carrying out your custom.”
