Rapists Spared Jail!

I wonder if this is the reason:

Officials could give no clear explanation for the rise in rapists spared jail, but one theory is that an increase in the number of cases brought to court has led to more convictions for non-violent rapes, particularly of men having sex with girls under the age of 16.

Someone would actually have to go through every single case to work it out: somthing which no one is going to bother to do. No doubt therefore we\’ll get screams fo a change in the law without ever actually knowing what is going on.

    That should be two convictions, though, surely…? I mean, the girls themselves are committing an illegal act by having sex under the age of 16. So why not charge them too…?

  2. Today, the law is that if a woman goes out, gets drunk, and has sex with a stranger, that stranger has committed rape. Being drunk, she is not able to consent.

    Never mind that she got drunk of her own free will, and even if he was as drunk as she was. Drunkeness voids her ability to make choices, but not his, y’see.

  3. @ JuliaM: because they *aren’t* committing an illegal act. English law doesn’t say “it is illegal to have sex under 16”, it says “it is illegal to have sex with a partner who’s under 16”. This is deliberately different from the way in which alcohol and driving-related age bans are phrased.

    @ the quoted extract – presumably they really mean girls under 13, not under 16? Sex with a child aged 13-15 is illegal in England, but it is only classed as rape if the child doesn’t consent – exactly the same as for someone aged 16 or over.

    (also, it’d be very damn unusual for an adult male to get caught sleeping with a girl of 12 or below and not go directly to jail – I suspect it hasn’t happened at all in the last 10 years. So I wonder what proportion of the 59 non-imprisoned rapists were actually young boys who had the misfortune to be caught with slightly younger girls…?)
