According to legal papers submitted before the trial, Bankman-Fried’s lawyers will argue he was just doing what he had been told was legal – a so-called “advice of counsel” defence – or blame the lawyers.

It’s unbelievable how badly he ran that. If he’d been even halfway straight he’d still be a billionaire. Oh, and free.

  1. Is it about character defects specific to Mr Brokeman-Unfreed or is it the sense of entitlement of someone whose parents are academic lawyers and big noises in the local Dem party?

    His mother is an authority on Ethics, you know.

  2. I have no knowledge of B-F or his company, but I do know that it is impossible to do business in the US without breaking some law or other. It is impossible for anyone (or any company counsel) to say with any reasonable degree of assurance that a course of action is definitely legal. The state and federal legal codes are literally unknowable.

    That is not to say that there aren’t crooks around, there obviously are.

    I remember reading somewhere* that Peter the Great had a policy of deliberately creating contradictory laws. That way he could have anyone arrested whenever he liked, and they’d definitely be guilty of something.

  5. 1. Everybody in these kind of cases pleads some version of “advice of counsel.” Nobody ever wins much on these, but there’s at least a possibility, and so the well-funded defense must plead it.

    2. I still am astounded that he, (with all the riches of the world and living in the Bahamas with a jet), managed to wait around long enough for the deputies to get him. He had plenty of warning. There must not have been one single real adult in the room with him ever.

    I doubt he had the savvy to be able to disappear into the world. He’s a typical internet era person – incapable of dealing with the offline world.
