Immigration judges backed his claim and rejected an appeal by the Home Office against him remaining in the UK. They ruled that it would breach his right to a family life based on Article 8 of the European Convention on Human Rights (ECHR) and that there was a risk of persecution because of his Kurdish birthright.
The tribunal was told that he was a “reformed” character, that his wife had stood by him over the affair and that his deportation would split the family as she would not be able to go to Turkey with him owing to her responsibility to support her two daughters and two grandchildren in the UK.
That is a significant burden to weigh againt….well, against what?

The more cases like this, the easier it will be for someone [cough]Nige/Kemi[cough] to say ‘We’re abolishing the Human Rights Act, its just a criminals charter’, and everyone bar the BBC/Grauniad will nod their heads and say (or think) ‘Too fucking right’. And then cases like this can be revisited and the crims chucked out.
If the usual suspects had any sense they’d make an example of a few high profile cases like this, while letting 90% get away with it. But they can’t help themselves and it’ll be their downfall.

If our government don’t start putting the human rights of the indigenous population to live free from foreign criminals over those of foreign criminals it will lead to the next government being elected on the basis that we will leave the ECHR.
The political classes were warned about the EU if they didn’t make changes, but didn’t listen the same wil happen here.
People should be equal before the law. Since we don’t deport a Londoner from Birmingham or Glasgow if they commit a crime there, we should not be deporting a foreigner either.
